Hi,
I’m an owner of a condo in New Jersey. I received a letter from the President of the Board stating that we owed late fees on all our HOA fees for the year of 2009 and the first two months of 2010. The president drew up this worksheet personally, and I had to point out two errors that I already caught. Our property management company never sent any notification that I was in arrears and owed all these late fees. I am asking for supporting documentation to show the date of receipt for each month showing that they were all late before I pay anything. The president wants me to pay up front and then if there are any errors, adjust my account after. I don’t want to pay until I see the supporting document. Do I have a legal right to withhold payment until they give me this?

The regular HOA dues are up to date. These charges are because they are stating that each month was received late, yet I never received anything stating that these were all received late and fees were being assessed. As far as I knew my account was up to date.
